The Mediation Notice in Your NJ Foreclosure Packet, Explained

By Igor Guberuk · September 17, 2026 · 6 min read

The short version

New Jersey’s Foreclosure Mediation Assistance Program is free for eligible homeowners — generally owner-occupants of one-to-three family homes fighting for their primary residence. Request it when you answer the complaint (njcourts.gov has the forms). At the table: you, a court-approved mediator, housing-counselor support, and a lender representative required to have settlement authority. Outcomes look like modifications, repayment plans and agreed exits. It costs nothing and runs alongside every other option.

What the program is

The mediation notice is not junk mail from the court — it is the door to the one room where your lender is required to send a person who can actually say yes. The program pairs eligible homeowners with a neutral, court-approved mediator and free housing-counselor support, and obligates the lender’s side to appear with settlement authority. There is no premium version of this; the free program is the program.

Who is eligible and how to ask

Eligibility centers on owner-occupants: generally the property is a one-to-three family home, it is your primary residence, and you are the borrower on the loan in foreclosure. You request mediation through the Judiciary — the packet you were served explains how, the forms live at njcourts.gov, and the request is commonly made with or shortly after your answer. Asking early matters: mediation works with whatever time and options remain, and both shrink as the case advances.

What a session actually looks like

Expect a scheduled conference — often remote — with the mediator steering, your financial documents doing the talking, and the housing counselor helping present a workable proposal: what you can pay, documented. Realistic outcomes include a modification review with a live timeline, a repayment plan for the arrears, more time to complete a sale, or a structured exit with dates everyone signed. Mediators cannot force a lender to modify; what the program forces is a real conversation with a real decision-maker, which is more than most homeowners ever get by phone.

How to arrive strong

Mediation rewards preparation the way court rewards procedure. Bring a complete, current financial package — a free HUD counselor will build it with you — and a specific ask. Keep your parallel tracks running: the answer filed, loss mitigation submitted, your equity math done. The homeowners mediation serves best walk in knowing their numbers and what they want. The notice in your packet is a free seat at that table. Take it.
